- The Michigan Supreme Court threw medical marijuana dispensaries to the Stone Age featuring a 4-1 decision Friday, 2-8-2013.
What this mean? Well, users of medical marijuana can not purchase the substance at pot shops. So the state's 126,000 certified users can have to boost their own pot, or previously alternative, purchase it from a state-licensed caregiver who can grow it for these guys.
"The state appeals court declared dispensaries illegal in 2011, but enforcement has depended regarding attitudes of local industry experts. Some communities took a hands-off approach while looking the Supreme court to improve the ultimate decision," reported myfoxdetroit.com.
The case arose from your own marijuana dispensary in Mt. Pleasant, MI that allowed users of medical marijuana to sell pot to one another. The owners of the phone store pulled within a 20 percent cut each sale. Isabella County shut the place down calling it an annoyance to the population.
Michigan's Medical marijuana Act is silent on whether dispensaries are allowed, thus cause for the litigation that arose, and continues up around california. You have to wonder if the legislature was purposely vague in drafting the Act's language enable the monkey wrench ricocheting around the pot law arena.
Whether this decision by the Michigan Supreme court is in the best interests of the pot user remains in sight.
What ya think?
Peace...
